1. Acceptance of Terms
By accessing or using the website located at https://skyrax.agency (the "Site") or engaging Skyrax Agency ("Company," "we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Site or services.
2. Services
Skyrax Agency provides digital growth services exclusively to dental practices, including AI Automation (AI voice agents, SMS workflows), Web Development, SEO, and Digital Marketing.
3. Client Obligations
You agree to provide accurate information and comply with all applicable laws, including HIPAA where applicable to your dental practice.
4. Fees and Payment
Fees are outlined in your Service Agreement. All prices are in USD. Late payments may incur a 1.5% monthly fee.
5. Results and Performance
Skyrax Agency makes no guarantee of specific outcomes or revenue figures. Projections are illustrative based on past performance.
6. Intellectual Property
Upon full payment, deliverables become your property, though Skyrax retains ownership of underlying tools and methodologies.
7. Confidentiality
Both parties agree to keep proprietary information confidential for a period of two (2) years post-termination.
8. HIPAA and Patient Data
We do not process PHI as standard. If access is required, a separate Business Associate Agreement (BAA) must be executed.
9. Termination
Either party may terminate with 30 days written notice. All outstanding fees become due immediately upon termination.
10. Limitation of Liability
Our total liability shall not exceed the fees paid to Skyrax Agency in the three (3) months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the State of Arizona. Disputes shall be resolved via binding arbitration in Phoenix.
12. SMS Terms & Conditions
By providing your phone number, you consent to receive SMS messages from Skyrax for appointment reminders and updates.
